The good news: selling a property on the Costa del Sol as a foreign owner follows the same process as for a Spanish seller. The difference lies in the paperwork and the taxes, and that is where many sales by non-resident owners get delayed by weeks or end with surprises at the notary.

In short: as a non-resident seller you need your NIE, up-to-date property and utility documents and, if you are not a Spanish tax resident, the buyer is legally required to withhold part of the sale price for the Spanish tax authorities. What keeps the sale on schedule is a local agent who manages the whole process end to end, rather than leaving it to the notary at the last minute.

Table of contents

🌍 1. What Changes When You Sell as a Non-Resident?

The stages are the same as in any sale: valuation, marketing, deposit contract and signing before a notary. But if your tax residence is outside Spain, there are three important differences:

💶 3% withholding: the buyer must withhold 3% of the sale price and pay it to the Spanish Tax Agency within one month (form 211). How to Sell Without Travelling to Spain

Many owners sell without travelling. To do so, you sign a power of attorney in favour of your lawyer or a trusted person, before a notary in your country (with the Hague Apostille and a sworn translation if needed) or at a Spanish consulate. With that power they can sign the deposit contract and the deed on your behalf.

The sale proceeds can be paid into your Spanish account or transferred abroad. What matters is agreeing in advance how payment will be made: which part is a transfer, how much is withheld for taxes and who handles each payment.

⚠️ 6.
