How to Buy a Property in Málaga: Complete Guide for Foreigners

1. Why Málaga?

Málaga has become one of the most desirable cities in Europe to live and invest in.
With more than 300 days of sunshine a year, a vibrant cultural scene, and an unbeatable quality of life, it’s easy to understand why people from all over the world are choosing this Mediterranean city as their new home.

From the cosmopolitan atmosphere of the city centre to the peaceful coastal towns nearby, Málaga offers a perfect balance between lifestyle and opportunity.
Whether you are looking for a holiday home, a permanent residence, or a smart investment, this city has something for everyone.

2. Understanding the Property Market

The property market in Málaga is strong and diverse.
You’ll find everything from modern apartments in the city centre to luxury villas overlooking the sea, and new developments with cutting-edge design.

Most popular areas:

  • City Centre: Ideal for those who love culture, restaurants, and historic charm.

  • East Málaga (El Limonar, Pedregalejo): Family-friendly and elegant.

  • Benalmádena & Torremolinos: Great for international residents and coastal living.

  • Marbella & Estepona: Luxury lifestyle with exclusive communities.

Prices vary depending on location and proximity to the coast, but compared to other Mediterranean destinations, Málaga still offers excellent value for money.

3. The Buying Process Step by Step

Buying a property in Spain is straightforward if you follow the correct legal process.
Here’s a simplified step-by-step overview:

1. Get your NIE (Número de Identificación de Extranjero)

This is a foreign identification number required for any property purchase in Spain. It can be obtained in Spain or at a Spanish consulate abroad.

2. Open a Spanish Bank Account

This will be used for payments, taxes, and utilities once you own the property.

3. Pay the Reservation Deposit

Once you find your ideal home, you’ll sign a reservation agreement and pay a deposit (usually between €3,000 and €6,000) to take the property off the market.

4. Sign the Private Purchase Contract

This contract outlines the terms of the sale, usually with a 10% deposit. It’s important to have your lawyer review it before signing.

5. Complete the Purchase at the Notary

Both parties sign the public deed of sale (“escritura pública”), and the balance is paid. Congratulations — you’re now a homeowner in Spain!

6. Register the Property

Your lawyer will handle the registration at the Property Registry and ensure all taxes and legal documents are up to date.

4. Legal and Financial Considerations

Spain has a transparent and well-regulated property market, but legal advice is essential.

Typical purchase costs:

  • Transfer Tax (ITP): 7–10% (depending on the region and type of property)

  • Notary & Land Registry Fees: 1–2%

  • Legal Fees: 1–2%

  • Mortgage Fees (if applicable)

Mortgages for foreigners:
Many Spanish banks offer mortgages for non-residents, financing up to 70% of the property’s value.

Important tip: Always work with an independent lawyer who speaks your language and represents your interests exclusively.

5. Living in Málaga

After buying your property, there are a few practical steps to take care of:

  • Empadronamiento: Register with the local town hall.

  • Utilities: Set up electricity, water, and internet contracts.

  • Health Insurance: Choose between public or private coverage.

  • Schools and Services: Málaga offers excellent international schools, hospitals, and transport connections.

Living here means enjoying outdoor dining, beach walks, and friendly people every day. The lifestyle is relaxed yet full of energy — truly Mediterranean in spirit.
