New builds on the Costa del Sol
Why buy a new build with Why Malaga?
Buying off-plan in Málaga or on the Costa del Sol from outside Spain means knowing the developer, the payment schedule and the guarantees well. We support you from choosing the development to the key handover:
Development selection: we compare developments in Estepona, Marbella, Mijas, Casares and Málaga by location, quality, delivery dates and price.
A protected purchase: we check the building licence, the bank guarantee or insurance for your stage payments and the purchase contract with independent lawyers.
Construction follow-up: we keep you updated on progress and inspect the home with you before handover.
A coordinated arrival: with our relocation service we handle your NIE, bank account, utilities and school in parallel.

Benahavis Centro, BenahavisGuide to buying a new build in Málaga and the Costa del Sol
How an off-plan home is paid for, what taxes apply, where to buy and how we work with you.
Taxes and payment schedule
New builds pay VAT and stamp duty (AJD) instead of transfer tax (ITP), and are paid in stages during construction. Read our complete tax guide.
Taxes on new builds
10% VAT plus 1.2% stamp duty (AJD) in Andalusia, plus notary and land registry. Set aside around 12% of the price for taxes and costs.
Off-plan payments
Usually a reservation deposit, between 20% and 40% of the price during construction backed by the developer's guarantee, and the rest at completion.
New developments by area
Where new builds are concentrated on the Costa del Sol and what kind of developments you will find in each area. As a reference, the average home price in the province of Málaga is €4,317/m² in September 2026, according to idealista; new builds are usually above that average.
Estepona
The area with the most new builds on the coast: beachfront developments and projects on the New Golden Mile. It is also the area with the biggest price rise, 17.1% in a year.
Marbella and San Pedro
Designer villas and boutique developments in East Marbella, Nueva Andalucía and San Pedro Alcántara, close to the beach and the golf courses.
Mijas Costa
Apartments and penthouses with sea views in La Cala, Calanova and Mijas Golf, half an hour from the airport.
Casares and Manilva
Developments by the golf courses and the sea at more moderate prices, between Finca Cortesín, Doña Julia and the Manilva coast.
Benahavís
Gated communities with golf, privacy and views, with high-end developments of apartments and villas.
Málaga city
Few developments and in high demand in El Limonar, the east of the city and the western seafront, with strong rental demand.

Frequently Asked Questions
Everything you need to know about new builds in Málaga and the Costa del Sol
Buying a new build off-plan as a foreigner raises very specific questions: how it is paid for, what guarantees you have, which taxes apply or when the home will be handed over. These are the questions our clients ask us most often. To go deeper, read our guide to buying a home in Málaga as a foreigner.
It means reserving and buying a home in a development that is still at the project or construction stage. You pay part of the price during construction and the rest when you sign the deed, once the home is finished and has its occupancy licence.
On a new build you do not pay transfer tax (ITP) but 10% VAT plus 1.2% stamp duty (AJD) in Andalusia. Notary, land registry and gestoría fees come on top. We explain it with examples in our guide to taxes when buying a house in Málaga.
Usually you pay a reservation deposit, then sign a purchase contract with payments during construction, often between 20% and 40% of the price in total, and pay the rest at completion, when the home is handed over. Each development has its own payment schedule.
Yes. The law requires the developer to guarantee the amounts you pay before handover with a bank guarantee or insurance, and they must be paid into a special account. If the building is not completed or does not obtain its licence, your money is returned. Always ask for your individual guarantee.
Spain’s Building Act (LOE) sets a one-year guarantee for finishing defects, three years for habitability defects and ten years for structural damage, covered by the developer’s ten-year insurance.
Yes. The mortgage is signed at handover, together with the deed, and banks usually lend non-residents between 60% and 70% of the value. Payments during construction are made from your own funds. We put you in touch with banks that work with international clients.
It depends on the stage at which you buy: from the start of works it usually takes between 18 and 36 months. The contract must set the delivery date and what happens if there are delays. There are also finished or nearly finished developments, ready to move in.
It is the municipal document, or the occupancy declaration (declaración responsable) in Andalusia, that certifies the home has been built according to the project and can be lived in. It is needed to sign the deed, connect utilities and obtain the mortgage.
In many developments you can choose finishes, flooring, kitchen or layout while construction allows it. The earlier you reserve, the more options you have. We help you negotiate the changes and their cost with the developer.
Estepona and the New Golden Mile have most of the developments, followed by Mijas Costa, Casares, Manilva, East Marbella and Benahavís. In Málaga city there is less supply and it sells quickly. We help you compare areas with real data.
New builds offer energy efficiency, guarantees, modern communal areas and staged payments, but you have to wait for handover. A resale home lets you move in sooner and negotiate the price more. You can see both options in our houses for sale in Málaga and the Costa del Sol.
Yes. We arrange video-call visits to the site and the show home, send you the floor plans, specifications and contract, and you can sign through a notarised power of attorney in favour of your lawyer. Even so, we recommend seeing the development in person before handover.
No. Since April 2025, buying a home no longer gives access to the Golden Visa. There are other routes, such as the non-lucrative residence visa or the digital nomad visa. We explain it in our article on the end of the Golden Visa in Spain.
Yes. With our relocation service we coordinate the purchase together with the NIE, bank account, utilities, school and healthcare, through a single point of contact.
